Hostess Brands Inc. and its second largest union will go into mediation to try save the snack company.
A bankruptcy judge hearing the case Monday said the two sides had not gone through mediation.
The Bakery, Confectionery, Tobacco Workers and Grain Millers International Union went on strike Nov. 9 without filing an objection to the final offer.
Hostess and the union are expected to begin the mediation process on Tuesday.
Company leaders said last week the company would be closed and sold off.
The company indicated there are potential buyers for some of its popular brands and recipes.
Twinkies alone brought in $68 million so far this year for the company.
