(Memphis A 24-year-old Raleigh man is behind bars accused of beating his 2-year-old stepson to death.

Michael Foster made his first court appearance this morning on charges of 1st-degree murder and aggravated child abuse.

Sean Lambert died back in April at Le Bonheur.

Police say foster initially told them he called 911 after he found Sean in his bed unconscious.

Later they say Foster admitted he was wrestling with the toddler and that he "got too rough."

The medical examiner says the toddler had cuts and bruises and damage to his internal organs.

The Child Advocacy Center says this means they will have to raise a flag for the 4th time this year.

"It's a tragedy and it speaks to all of us as adults for seeing that children in our neighborhood are safe," said Nancy Allen.

The Child Advocacy Center raises a flag every time a child in Shelby County dies from child abuse or neglect.

Police have not said why it took so long to charge Foster in this case.

He is being held without bail.
