(Memphis) District 4 Memphis City School Board candidate Kenneth Whalum Jr. announced Thursday he would move forward with a lawsuit against the Shelby County Election Commission.

Whalum filed the lawsuit after losing his race by nearly one hundred votes. He blames problems at the polls and wants the current results thrown out.

“There is no question that I lost the election as they certified. I couldn’t file a lawsuit but if I lost because of the errors reported by the state comptroller’s office then I get to have the opportunity to win,” Whalum said.

Tennessee’s Comptroller Office released a report Tuesday citing errors with ballot issues due to poor planning and mistakes in the redistricting process.

A trial is scheduled to take place next Wednesday.
